Terms and Conditions

These Terms and Conditions ("Terms") govern your use of southfloridaautodeals.com (the "Site") and the car-buying concierge services offered by SoFlo Auto Deals ("SoFlo Auto Deals," "we," "me," "my," or "us"). By using the Site, submitting a request, or using our services, you agree to these Terms. If you do not agree, do not use the Site or our services.

1. What the service is

SoFlo Auto Deals is a car-buying concierge and auto brokerage service serving South Florida. You tell us the vehicle you want. We search for it, negotiate the price and terms with dealerships on your behalf, and coordinate the paperwork and financing so the transaction is ready when you arrive at the dealership.

2. Cost to you and how we are paid

Our service is free to you. We are compensated by the dealership when you complete a purchase or lease that we arranged. That compensation comes out of the dealership's own budget. You are not charged a fee by us, and our compensation does not increase the price you pay.

We disclose this arrangement so you understand our economic relationship with dealerships. If you would like to know how we are compensated on a specific transaction, ask us and we will tell you.

You acknowledge and agree that, in order to locate and negotiate a vehicle for you, we will provide your request and contact information to one or more dealerships. That is the mechanism by which the service works and we cannot perform it otherwise. We do not sell, rent or license your information to data brokers, lead resellers or anyone else. Your consent to receive text messages is handled separately and is never sold or transferred. No dealership or partner receives it, and none may text or autodial you based on permission you gave to us.

3. Eligibility

You must be at least 18 years old and legally able to enter into a contract. Our service is intended for people buying or leasing vehicles in South Florida, primarily Broward, Miami-Dade and Palm Beach counties. We may source a vehicle located elsewhere in the country, but the transaction is completed through a dealership.

4. The information you give us

You agree that the information you give us is accurate, current and your own. You agree not to submit someone else's phone number or email address, or to submit a request on someone else's behalf without their permission. Providing false information may result in us declining to work with you.

5. No guarantee of outcome

We work to get you the best available price and terms. We do not guarantee any specific price, discount, savings amount, rebate, incentive, interest rate, approval, trade-in value, vehicle availability, or timeline. Vehicle pricing, manufacturer programs and inventory change constantly and are controlled by dealerships and manufacturers, not by us.

Any figures, examples or estimates we share are illustrative and not a promise of what you will receive.

6. Dealerships, lenders and other third parties

Dealerships, lenders, manufacturers, insurers and transport companies are independent businesses. We do not control them and we are not responsible for their acts, omissions, pricing, disclosures, financing terms, products, warranties, service, or the condition or quality of any vehicle.

Any dispute about a vehicle, its condition, its financing, or the dealership's conduct is between you and that business. You should inspect any vehicle and read every document before you sign it.

7. Referral program

We may offer a referral reward of $250. Unless we tell you otherwise in writing, the following apply:

• The reward is earned only when the person you referred completes a purchase or lease that we arranged, and the transaction funds and is not unwound.
• The person you referred must be new to us and must identify you as the referral source at or before their first substantive contact with us.
• Payment is issued within a reasonable time after the transaction funds.
• If a transaction is cancelled, unwound or reversed, no reward is owed, and any reward already paid may be reclaimed.
• You may not refer yourself, members of your own household, or people you compensate to be referred.
• You are responsible for any taxes on rewards you receive.
• We may change or end the referral program at any time. Changes do not affect rewards already earned.

8. Calls, texts and emails

By giving us your phone number or email address, you agree that we may contact you about the request you submitted, including by phone, text message and email.

Separately, if you check the marketing consent box on our form, you give express written consent to receive marketing calls, texts and emails from SoFlo Auto Deals at the number and email you provided, including messages sent using automated technology. That consent is not a condition of any purchase or of using our service. Message frequency varies. Message and data rates may apply. Reply STOP to any text to opt out, or HELP for help. You may unsubscribe from marketing email at any time using the link in the email.

Calls may be recorded or monitored for quality and training, with notice at the start of the call. See our Privacy Policy for details on how we handle your information.

9. Acceptable use of the Site

You agree not to use the Site to break the law, to submit false or fraudulent information, to interfere with the Site's operation, to attempt to gain unauthorized access to our systems, to scrape or harvest data, or to copy our content for a competing service.

10. Our content

The Site and its content, including text, images, layout, graphics and the SoFlo Auto Deals name and marks, are owned by us or used with permission, and are protected by intellectual property laws. You may view and print pages for your own personal, non-commercial use. Any other use requires our written permission.

11. Disclaimer of warranties

The Site and our services are provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error free, or free of harmful components, or that any information on it is complete or current.

12. Limitation of liability

To the fullest extent permitted by law, SoFlo Auto Deals and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost savings, lost data, or loss of goodwill, arising out of or relating to the Site, our services, or any vehicle transaction, whether based in contract, tort, negligence, strict liability or otherwise, even if we were advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Site or our services will not exceed one hundred dollars ($100.00).

Some jurisdictions do not allow certain limitations, so parts of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold harmless SoFlo Auto Deals and its owners, employees and agents from any claims, damages, losses and reasonable attorneys' fees arising out of your use of the Site or our services, your breach of these Terms, or your violation of any law or the rights of a third party.

If you have a problem, contact us first at (954) 778-3484 or info@southfloridaautodeals.com. Most issues are resolved quickly. You agree to give us at least thirty (30) days to resolve a dispute informally before starting a formal proceeding.

16. Other terms

• Changes. We may update these Terms. The "Last updated" date will change. Continuing to use the Site after a change means you accept the updated Terms.
• Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
• No waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.
• Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Site and our services.
• Assignment. You may not assign these Terms. We may assign them in connection with a sale or transfer of the business.
